Federal Court Mandates Release of Abrego Garcia from Immigration Custody

A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.

The situation originates in a mistaken deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was detained in federal custody.

In her order, the judge noted that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal proceedings center on disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.

The court, who was hearing his challenge to removal in a Maryland district court, determined that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
